FUSE TV - Fuse 2013-2014 Upfront Game Official Rules

The Fuse 2013-2014 Upfront Game (“Game”) runs from April 2, 2013 through June 30, 2013 (“Game Period”).

Who may play: Game open only to legal residents of the 50 United States or the District of Columbia who are (1) at least 18 years of age at time of entry and (2) in attendance at an Upfront Meeting (collectively, the “Event”) during the Game Period. Employees, officers and directors, their immediate family members (spouse, siblings, children and parents, regardless of where they live) or members of the same households (whether related or not) of Fuse Networks, LLC (“Sponsor”), its parent, affiliates, subsidiaries, printers, advertising and promotion agencies and those associated with the development, implementation or execution of this Game are not eligible to participate.

How to Play: Receive one (1) game card, while supplies last, from a Sponsor Representative at the Event, while supplies last. Scratch off the area indicated to find out if you’ve won a prize.   

How to Redeem Prize:  If your game card displays a winning message, present the original game card to a Sponsor representative at the Event to redeem your game card for the prize indicated. Game card must be redeemed at the Event that the game card was obtained or the game card will be void.  All winning game cards and prize awards are subject to verification of eligibility and compliance with the terms of these Official Rules.

Winners of a gift card, Beats by Dre Solo, Jawbone Jambox or iPod Nano prize will receive their prize following verification of winning game card, eligibility and compliance with the terms of these rules.  Potential winners of trip and guitar prizes will be required to execute and return an affidavit of eligibility, a liability release and, where lawful, a publicity release. If such documents are not returned within the specified time period, a prize or prize notification is returned as undeliverable, a potential winner is not in compliance with these rules, or Sponsor is unable to contact the potential winner within a reasonable time period, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected.  If a potential winner is at least 18 but still considered a minor in his/her jurisdiction of residence, prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winners set forth herein. 

Prizes Available to be Won:  

(1) VIP Trip for Two (2) to Bonnaroo Music and Arts Festival, scheduled to take place in Manchester, TN in June 2014 (Approximate Retail Value (”ARV”): $3,000.)  Trip package includes round trip, coach-class air transportation for two (2) between the major airport closest to the winner’s residence and trip destination; four (4) nights' accommodations at a hotel determined by Sponsor in its sole discretion (one (1) standard room, double occupancy); and two (2) tickets to Bonnaroo. Odds of winning 1:1800.

(1) VIP Trip for Two (2) to Lollapalooza scheduled to take place in Chicago, IL from August 2-4, 2013 (Approximate Retail Value (”ARV”): $3,000.)  Trip package includes round trip, coach-class air transportation for two (2) between the major airport closest to the winner’s residence and Chicago, IL; three (3) nights' accommodations at a hotel determined by Sponsor in its sole discretion (one (1) standard room, double occupancy); and two (2) tickets to Lollapalooza. Odds of winning 1:1800.

(1) VIP Trip for two (2) to Voodoo Music and Arts Experience scheduled to take place in New Orleans, LA from November 1-3, 2013 (Approximate Retail Value (”ARV”): $3,000.)  Trip package includes round trip, coach-class air transportation for two (2) between the major airport closest to the winner’s residence and New Orleans, LA; three (3) nights' accommodations at a hotel determined by Sponsor in its sole discretion (one (1) standard room, double occupancy); and two (2) tickets to the Voodoo Festival. Odds of winning 1:1800.

Trip Prize Conditions/Restrictions: Travel and accommodations are subject to availability. Travel must be round trip.  Sponsor will determine airline and flight itinerary in its sole discretion.  No refund or compensation will be made in the event of the cancellation or delay of any flight. Travel is subject to the terms and conditions set forth in this Game, and those set forth by the Sponsor’s airline carrier of choice as detailed in the passenger ticket contract. All expenses and incidental travel costs associated with prize acceptance and use not expressly stated in the package description above as being provided, including but not limited to, ground transportation, meals, incidentals, gratuities, passenger tariffs or duties, airline fees, surcharges, airport fees, luggage fees, service charges or facility charges, personal charges at lodging, security fees, taxes or other expenses are the responsibility solely of winner. Unless child or legal ward of a winner, travel companion must be eighteen (18) years of age or older as of the date of departure and must travel on same itinerary and at the same time as the winner.  If the winner is at least 18 but still considered a minor in his/her state of residence, travel companion must be winner’s parent/legal guardian. Travel companion must execute liability/publicity release prior to issuance of travel documents. Travel restrictions, conditions and limitations may apply.  If in the judgment of Sponsor air travel is not required due to winner’s proximity to prize location, ground transportation will be substituted for round trip air travel at Sponsor’s sole discretion and no compensation or substitution will be provided for difference in value (if any). Sponsor will not replace any lost, mutilated, or stolen tickets, travel vouchers or certificates. Tickets are subject to terms and conditions set forth thereon. Seat locations (in any) will be determined by Sponsor.  Winner and guest must comply with all venue rules and regulations.  Failure to do so may result in forfeiture of such portion of prize.  Sponsor is not responsible if the event is delayed, postponed or cancelled for any reason, in which event that portion of prize is forfeited in its entirety and no substitution will be provided except as in Sponsor’s sole discretion and Sponsor will have no liability. Actual value of the prize may vary based on airfare fluctuations and distance between departure and destination.  Winner will not receive difference between actual and approximate retail value. 

(5) Gibson Electric Guitar (ARV: $1,000 each).  Exact guitar will be determined by Sponsor in its sole discretion. Odds of winning 1:360.

(10) $100 Ticketmaster Gift Cards (ARV: $200 each) Odds of winning 1:180.

General Prize Conditions/Restrictions: Gift card terms apply. Prizes are provided “as-is” without any warranties or guarantees.  Sponsor reserves the right to substitute a prize of comparable or greater value, at Sponsor’s sole discretion. Prizes are not transferable. No substitutions or cash redemptions except in the sole discretion of the Sponsor.  Each winner is responsible for any applicable fees, federal, state and/or local taxes, and any other unspecified expenses associated with acceptance or use of prize. Total ARV of all prizes: $25,789.40. Limit one (1) prize per person for the Event. Unclaimed prizes will not be awarded. 

Publicity Grant: Each winner (except where prohibited), by acceptance of a prize, consents to use by Sponsor and its designees of his/her name, city and state of residence and likeness in advertising and promotional materials in any and all media now or hereafter devised, in any manner, worldwide in perpetuity, without notice, permission or additional compensation.

General: Game card is void if not obtained from authorized and legitimate channels, or if the game card is, in whole or in part, illegible, incomplete, damaged, irregular, altered, counterfeit, produced in error or obtained via fraud or theft.  Released Parties (as defined below) are not liable for printer errors or issuance of any void, misprinted, or irregular game card resulting from production or packaging problems or errors. Liability for an irregular game card is limited to providing another game card, while supplies last, subject to verification of original game card irregularity. In the event production, seeding, printing, human or other errors cause more than stated number of prizes to be available and/or claimed, Sponsor reserves the right to award the prizes by random drawing among all eligible claimants who submitted legitimately received valid game cards. In no event will Sponsor be liable for awarding more than the stated number of prizes. Released Parties are not responsible for errors or difficulties of any kind whether human, mechanical, typographical, printing or otherwise relating to or in connection with the Game, including, without limitation, errors or difficulties which may occur in connection with the administration of the Game, the announcement of the prizes or in any Game-related materials.  Sponsor reserves the right to disqualify any person found or suspected of tampering with the entry process or the operation of the Game, to be acting in violation of these Official Rules, to be acting in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person and void all game cards.  Sponsor reserves the right to modify, suspend or cancel the Game if, it determines that the Game is not capable of running as planned for any reason, including but not limited to, tampering, unauthorized intervention, fraud, technical failures, or any other causes which Sponsor deems could corrupt or affect the administration, security, fairness or proper conduct of this Game. Sponsor shall post notice of any such action at the Event. By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which shall be final and binding in all respects. By participating in this Game, participants hereby waive and release, and agree to hold harmless Sponsor, its parent, affiliates, subsidiaries, media partners, printers, and advertising and promotion agencies and all of their respective officers, directors, and agents (collectively, “Released Parties”) from and against, any and all rights, claims and causes of action whatsoever that they may have, or which may arise, against any of them for any liability for any matter, cause or thing whatsoever, including but not limited to any injury, loss, damage, whether direct, compensatory, incidental or consequential, to person, including death, and /or property, arising in whole or in part, directly or indirectly, from their acceptance, possession, use or misuse of any prize (including any travel or activity related thereto) or their participation in this Game. 

Winners List: For the list of winners of prizes valued at $25 or higher, send a self-addressed stamped envelope to: “Fuse 2013-2014 Upfront Game Winners” c/o Fuse Networks LLC, 11 Penn Plaza, 17^th Floor, New York, New York 10001, for receipt no later than July 31, 2013.
